These Terms & Conditions apply to purchases made through the Vale Ro website.

Vale Ro is the independent artistic practice of Valeria Rodríguez Oré, based in Barcelona, Spain.

By purchasing a work through this website, you acknowledge that you are acquiring an original, handmade work of art and agree to the following terms.

1. About Vale Ro

Vale Ro is the artistic practice of Valeria Rodríguez Oré, an independent artist based in Barcelona, Spain.

The Shop offers original ceramics, linework, paintings, sculptural works and, where available, commissioned and personalised pieces.

2. Original and Handmade Works

Unless expressly stated otherwise, every ceramic object, drawing, painting and sculptural piece offered through Vale Ro is an original work created by the artist.

Many works are one of a kind and cannot be identically reproduced or replaced.

Handmade ceramics may present subtle variations in surface, glaze, texture, form, colour, firing marks and finish. These characteristics are inherent to the making process and form part of the individuality of each work.

Every effort is made to represent each artwork accurately through photographs and descriptions. Colours may vary slightly depending on lighting, photography and individual screen settings.

These natural characteristics do not affect any mandatory consumer rights relating to defective, damaged or non-conforming goods.

3. Availability

Because many works are unique, availability is limited to the quantity shown on the website.

A work is considered sold once payment has been successfully completed.

In the unlikely event that a work has been sold simultaneously through another channel or is otherwise unavailable, Vale Ro will contact the customer and cancel the order, providing a full refund of any payment received.

4. Prices and Payment

All prices are displayed in euros (€), unless otherwise stated.

Applicable shipping costs and any other charges that must be disclosed before purchase will be shown during the checkout process.

Payments are securely processed through the payment methods available at checkout, which may include services provided by Stripe, PayPal, Squarespace Payments or other payment providers made available through the website.

Vale Ro does not directly store full payment-card information.

5. Final Sale and Statutory Consumer Rights

Due to the unique, handmade and often one-of-a-kind nature of the works, Vale Ro does not offer voluntary returns, exchanges or change-of-mind refunds beyond the rights required by applicable law.

This policy does not restrict or exclude any statutory consumer rights that cannot legally be waived.

Where a statutory right of withdrawal applies to an online purchase, that right will be respected in accordance with applicable law.

Customers also retain any applicable legal remedies relating to goods that are defective, damaged, incorrectly supplied or otherwise fail to conform to the purchase agreement.

6. EU Right of Withdrawal

For eligible online purchases made by consumers within the European Union, the customer generally has a statutory 14-calendar-day right of withdrawal, beginning on the day the customer or a person designated by them receives the artwork.

The customer may also use any applicable withdrawal form or other unequivocal written statement expressing their decision to withdraw.

Where the right of withdrawal is exercised, the artwork must be returned within the applicable legal period and with reasonable care.

The customer is responsible for the direct cost of returning the artwork where this has been communicated before purchase and where applicable law permits.

The customer may be responsible for any diminished value resulting from handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the artwork.

Where a refund is due following a valid withdrawal, it will be processed in accordance with applicable consumer law.

7. Exceptions for Commissioned and Personalised Works

The statutory right of withdrawal does not generally apply to goods made to the consumer's specifications or clearly personalised, where the applicable legal requirements for the exemption are met.

Commissioned works are therefore subject to separate terms agreed with the customer before production begins.

A commission may include specific requirements concerning:

  • design;

  • dimensions;

  • colours;

  • materials;

  • subject matter;

  • production timeline;

  • price;

  • payment schedule; and

  • shipping.

Any deposit paid for a commission may become non-refundable once production has begun, subject to the specific commission agreement and applicable law.

8. Shipping

All works are packed individually from the Vale Ro studio in Barcelona.

Shipping rates are calculated according to destination and the packed weight and dimensions of the artwork.

Once an order has been dispatched, the customer will receive available tracking information where the selected shipping service provides it.

Delivery times are estimates and may vary due to the carrier, destination, customs procedures or circumstances outside Vale Ro's reasonable control.

Where no specific delivery date has been agreed, applicable consumer rights regarding delivery times remain unaffected.

9. International Orders and Customs

Vale Ro currently ships primarily to Spain, the European Union and the United Kingdom.

Customers outside the European Union may be required to pay customs duties, import taxes or other charges imposed by their country of destination.

Unless expressly stated otherwise at checkout, these charges are not included in the artwork price or shipping fee and are the responsibility of the recipient.

Vale Ro is not responsible for customs delays or charges imposed by destination authorities.

10. Damage in Transit

Each work is carefully packed with particular attention to the fragile nature of ceramic and sculptural pieces.

If a work arrives damaged, please contact info@vale-ro.com within 48 hours whenever possible and include:

  • your order number;

  • photographs of the damaged artwork;

  • photographs of the external box;

  • photographs of the internal packaging; and

  • photographs of the shipping label.

Please retain all original packaging until the matter has been resolved, as the carrier may require it for inspection.

The 48-hour notification request is intended to allow Vale Ro to pursue a transport claim promptly and does not limit any mandatory statutory rights.

Because many works are unique, an identical replacement may not be possible. Depending on the circumstances and applicable law, an appropriate remedy may involve.

11. Faulty or Non-Conforming Works

If an artwork arrives damaged, is defective, is materially different from its description, or otherwise fails to conform to the purchase agreement, the customer retains the statutory remedies provided by applicable consumer protection law.

For consumers in the European Union, goods must generally be brought into conformity free of charge or, where appropriate, the consumer may be entitled to a price reduction or refund. EU consumer rules provide a minimum two-year legal guarantee for goods, subject to the applicable national rules and circumstances.

Nothing in these Terms & Conditions limits those statutory rights.

12. Ownership and Copyright

Purchasing an artwork means purchasing the physical work only.

All copyright, reproduction rights and other intellectual-property rights remain with Valeria Rodríguez Oré / Vale Ro, unless expressly transferred through a separate written agreement.

The purchase of a work does not grant permission to reproduce its image for commercial purposes, manufacture copies, create derivative commercial products or otherwise commercially exploit the artwork.

Collectors are welcome to photograph and share their acquired works for personal and non-commercial purposes, with appropriate credit to the artist where reasonably possible.

13. Care of the Work

Each artwork should be handled with appropriate care.

Ceramic and sculptural works may be made from durable materials but remain breakable objects.

Where a work is suitable for holding water, food use, heat or another specific function, this will be indicated in its individual product description.

Vale Ro is not responsible for damage resulting from falls, impacts, misuse, unsuitable cleaning methods or handling inconsistent with the care instructions supplied with the work.

14. Changes and Cancellation of Orders

Because many works are unique and may be prepared for dispatch shortly after purchase, changes or cancellations cannot be guaranteed once an order has been placed.

Please contact info@vale-ro.com as soon as possible if an error has been made in an order.

Nothing in this section limits a consumer's mandatory statutory rights, including any applicable right of withdrawal.

15. Governing Law and Consumer Rights

These Terms & Conditions are governed by Spanish law.

For consumers, this does not remove or restrict any mandatory consumer protection rights that may apply under the laws of their country of habitual residence.
